A judge may deviate upward or downward from the scheduled amount based on any relevant evidence. In its simplest form, the parent without physical custody would pay child support to the parent with physical custody. No parent is relieved of an obligation of support due to lack of visitation or custody. Child support may be determined by state agency or a judge of the Juvenile and Domestic Relations Court or the Circuit Court. Ordinarily, the court will continue to have jurisdiction to modify its support order in the event of a change in circumstances. Lawyer James H.
